1. ABOUT THIS END USER LICENCE AGREEMENT

1.1 This End User Licence Agreement (or “EULA”) governs the relationship between you and or “SKARA The Blade Remains Ltd” from Flat 4, 3-5 Bateman Street, London W1D 4AG (“SKARA” or the “Game”).

1.2 EULA means this end user licence agreement, including any amendments to this end user licence agreement from time to time.

1.3 This EULA incorporates:

– The rules and guidelines that apply to your use of the Game (the “Game Rules“).

– The rules and guidelines that apply to your use of the Game Forum (the “Forum Rules”).

– The Terms of Service governing the relationship between you and SKARA (the “Terms of Service”).

– How we treat information that you provide to us or that we collect about you (the “Privacy and Cookie Policy”).

You must also accept and comply with all rules of external platforms applicable to specific Game, including but not limited to, Xbox Games and other Xbox services rules, Apple Appstore and Game Center rules, and Google Play rules. Any breach of any rules of the external platforms shall also be regarded as a fundamental breach of the Terms of Service by you.

This EULA together with third parties’ rules and other documents that you accept set out how we expect you to behave when playing the Game.  Please review them carefully before playing the Game.

  1. THIS EULA AND YOU

2.1 Please read EULA carefully before clicking the “I agree” button.

2.2 If you are under 18 years of age, please ask your parent or guardian to review and approve this EULA on your behalf.  If you are under the aforesaid age, you must not use or access the Game without a parent or legal guardian supervising you.

2.3 By clicking the “I agree” button, installing or using the Game, you are agreeing to be bound by terms of service of this EULA. If you do not agree to this EULA, do not attempt to install or use the Game.

2.4 You confirm your agreement to this EULA including the Game Rules as part of the installation process of the Game (if applicable) or by using the Game. If you do not agree to this EULA, please do not attempt to install or use the Game.

  1. AMENDMENTS TO THIS EULA

3.1 From time to time, we may need to amend this EULA for serious reasons, for example to reflect new features and functionality in the Game or because of changes in the law. If we make a change to this EULA, we will inform you via email about those changes and of your right not to accept them. The latest version of this EULA will always be available on the SKARA websites (the “Sites“). Please make sure you check for updates to this EULA each time you use the Game. Changes to this EULA shall not affect your accrued rights and shall not have retroactive effect.

3.2 From time to time we may also need to amend the Game Rules for serious reasons, for example to address issue that may arise in the Game or the way that the Game is being played and to ensure that the Game continues to be enjoyable for all users. If we make a change to these Game Rules, we will inform you via email about those changes and of your right not to accept them. The latest version of the Game Rules will always be available on the Sites. Changes to the Game Rules shall not affect your accrued rights and shall not have retroactive effect.

3.3 From time to time, we may also need to amend the Terms of Service, for example to reflect or include new products or services, to enhance security for our users or because of changes in the law. Also, we may from time to time need to amend the Forum Rules for serious reasons, for example to ensure that the Games Forums operate smoothly and to reflect the needs of the community using the Games Forums. If we make such a change to these Terms of Service and/or to the Forum Rules, we will inform you of the particular changes in advance via e-mail no later than thirty (30) calendar days before such changes come into force and that you shall be deemed to have accepted these changes (i) unless you have notified us of your objection to such changes within thirty (30) calendar days from the moment of receipt the e-mail notification from us, or (ii) if you use the Services after the changes have entered into force. In the e-mail notification, we will inform you of your right to object, of the applicable notice period and the legal consequences of a failure to object.

3.4 In case you object to any changes as set out in article 3 “AMENDMENTS TO THIS EULA”, the previous version of the respective EULA shall continue to apply. However, in that case we have the right to close your Account and terminate these EULA with fourteen (14) calendar days’ notice. In case of such termination, you are entitled to a refund according to article 15 of section 2 “Suspension and Closure of Your Account / Termination of these Terms of Service”.

3.5 The latest version of these Terms of Service and of the Forum Rules shall always be available on the Sites, so we recommend that you check for updates to these Terms of Service and to the Forum Rules each time you use the Services. Changes to the Terms of Service and/or the Forum Rules shall not affect your accrued rights, shall not substantially disrupt the contractual balance between you and us under these EULA and shall not have retroactive effect.

  1. USING THE GAME

4.1 In return for your acceptance of this EULA, we give you the personal right (known as a ‘licence’) during the time this EULA is in force between you and us to download, install and play the Game.

4.2 This licence is:

(a) ‘non-exclusive’ (meaning that we can grant the same and similar licences to other people as well);

(b) ‘revocable’ (meaning that we can terminate this licence in certain circumstances, which are explained further below);

(c) ‘personal’ (meaning that you may not use the Game for any commercial purpose);

(d) ‘non-transferable’ (meaning that the licence is only for your benefit and you may not transfer or sub-licence any of the rights that we grant to you to any other person); and

(e) ‘limited’ (meaning that you can only use the Game for the purposes we set out in this EULA); and

(f)  conditional on your compliance with this EULA.

  1. TECHNICAL REQUIREMENTS

For using the Game you need certain hardware, software and capability (including a suitable connection to the Internet).

  1. PATCHES, UPDATES AND CHANGES

From time to time, we may need to deploy or provide patches, updates, additional content or other modifications to the Game (for example to enhance online gameplay, to add new or update features or to resolve software bugs). You hereby accept, recognize and understand that we constantly work on further development of the Game and Services, we improve, upgrade and update graphics, features, gameplay and any other Content of the Game in order to make the gameplay enjoyable for you.

  1. INTELLECTUAL PROPERTY

7.1 The Game, including the code, graphics, game play, user interface, audio and other content, contain proprietary information and material that is protected by copyright and other laws including but not limited to intellectual property.  You agree that we own or licence all of this proprietary information and material and that you may not use or exploit any of it without our permission.

7.2 “SKARA”, “SKARA The Blade Remains” and their respective logos are trademarks or registered trademarks of SKARA The Blade Remains Ltd. You may not use or display such trademarks in any manner, except as expressly set out in this EULA. All third party trademarks and service marks that appear in the Game are the property of their respective owners and all rights in them are reserved.

  1. EPILEPSY WARNING

Certain people are susceptible to epileptic seizures or loss of consciousness when exposed to certain flashing lights or light patterns in everyday life.  Such people may have a seizure while watching certain monitor images or playing certain video games.  This may happen even if the person has no medical history of epilepsy or has never had any epileptic seizures.  If you or anyone in your family has ever had symptoms related to epilepsy (seizures or loss of consciousness) when exposed to flashing lights, consult your doctor prior to playing.  We advise that parents should monitor the use of video games by their children.  If you or your child experience any of the following symptoms: dizziness, blurred vision, eye or muscle twitches, loss of consciousness, disorientation, any involuntary movement or convulsion, while playing a video game, IMMEDIATELY discontinue use of the video game and consult your doctor.  Please also note that when using a video game you should take certain standard health and safety precautions, including avoiding playing the game when tired and not had much sleep, taking 10 to 15 minute breaks every hour, sitting a reasonable distance from the screen, and playing the game in a well-lit environment.

  1. WARRANTIES AND LIABILITY REGARDING THE GAME

9.1 We warrant that we have the right to enter this EULA and to grant you the licences to use the Game set out in section 4 (“USING THE GAME”);

9.2 We shall be liable for damages with respect to injuries to health, body or life or for intentional damages caused by us, our representatives, employees or our vicarious agents or according to the applicable law.

9.3 With respect to virtual goods that are purchased by you, we shall be liable in addition to article 2 of the present section 9 for damages that arise from the lack of a guaranteed characteristic or gross negligence of us, our representatives, or designated agents.

9.4 And further liability of us shall be waived.

  1. GOVERNING (APPLICABLE) LAW AND JURISDICTION

10.1 This EULA and any dispute, claim or obligation (whether contractual or non-contractual) arising out of or in connection with it or its subject matter or formation shall be governed by the laws of England, unless otherwise required by the law of the country where the user has his habitual residence.

10.2 We and you submit all the aforementioned disputes to the jurisdiction of the courts of the country whose laws are applicable subject to article 1 of the present section 10 “GOVERNING (APPLICABLE) LAW AND JURISDICTION”.

  1. GENERAL

11.1 The EULA governs our relationship with you. It does not create any rights for any other person, unless otherwise expressly stated in this EULA.

11.2 If any part of this EULA is held to be unenforceable, then it will not affect the enforceability of any other part of this EULA. Also, we and you agree to interpret the rest of this EULA in such a way as to reflect your and our intentions in this EULA as fair as possible.

11.3 If you or we fail to exercise (or delay exercising) any right which you or we may have under this EULA, that failure or delay does not mean that we or you lose that right.  If we or you only partially exercise a right or only exercise it once, that will not stop you or us from exercising it again in the future.

  1. NO RESTRICTION OF CONSUMER RIGHTS

The provisions of this EULA do not exclude, limit or otherwise restrict the rights vested with the consumers upon relevant provisions of applicable law nor may be construed by anyone in this way.

  1. GAME RULES

IMPORTANT! PLEASE READ CAREFULLY!

BY INSTALLING, COPYING, OR OTHERWISE USING OUR GAME(S) OR SERVICE(S) IN ANY MANNER, YOU AGREE TO BE BOUND BY THE TERMS OF THESE RULES.

IF YOU DO NOT AGREE WITH OUR RULES FOR SKARA, PLEASE DO NOT PROCEED WITH THE REGISTRATION PROCESS AND LEAVE OUR SITES IMMEDIATELY AND DO NOT ACCESS OR USE OUR WEBSITE(S), GAME(S), OR SERVICE(S).

13.1 The Game Rules set out how we expect you to behave when playing the Game.  Please review the Game Rules carefully before playing the Game. Please note that ‘role-playing’ is not an excuse for contravening the Game Rules.

13.2 If you are in material breach with the Game Rules, then we may, at our reasonable discretion depending on the seriousness of the breach take some or all of the following actions:

(a) suspend your access to the ‘game chat’ functionality in the Game for a short period of time;

(b) suspend your access to the ‘game chat’ functionality in the Game for a longer period of time; and

(c) suspend or close your Account as provided in the Terms of Service.

If the breach is your first breach, if it is not flagrant, if it is capable of cure, and if the circumstances allow us to do so, then we shall give you 14 (fourteen) calendar days prior written notice of the impending Account closure to give you the opportunity to cure the breach during such time period. If we suspend your Account, then during the period of that suspension you will not be able to access your Account or use any of the Services.  If we close your Account, then you will never be able to access your Account and we may also prohibit you from accessing or using the Services in the future.

13.3 If we suspend your access to the ‘game chat’ functionality in the Game, then during the period of that suspension you will be able to play the Game and read the ‘game chat’ of other players, but will not be able to participate in ‘game chat’.

13.4 If you encounter another user who is contravening any of the Game Rules, please report this activity to SKARA using the “Help” or “Report Abuse” functions in the Game if available, or otherwise contact Customer Support at contact@skarathebladeremains.com

13.5 General Provisions

13.5.01 In order to register in SKARA, players must be thirteen (13) years of age or older. All players are solely responsible for their behavior in both public and combat chat. Players are responsible for protecting their accounts from access by others, and are strongly encouraged to select a hard-to-guess password and not re-use that password on any other sites where it may be read by the owners or administrators of that site. In the case of an account that has been lost or hacked, please inform technical support immediately through contact@skarathebladeremains.com

13.5.02 The developers (SKARA The Blade Remains) of this software are not responsible for the behavior of any individual player, as well as for the content of his or her messages in all game chats and channels. Players are solely responsible for their behavior and the content of their messages in all game chats and channels.

13.5.03 SKARA The Blade Remains reserves the right to evaluate each incident on a case by case basis. The action that may be taken may be more lenient or more severe than those listed under each category.

13.5.04 SKARA The Blade Remains may suspend, terminate, modify, or delete accounts at any time for any reason or for no reason, with or without notice to the owner of the account. Accounts terminated by SKARA The Blade Remains for any type of abuse, including without limitation a violation of these rules or the EULA, will not be reactivated for any reason. For purposes of explanation and not limitation, most account suspensions, terminations and/or deletions are the result of violations of these rules, the End-User License Agreement (EULA), or other SKARA The Blade Remains policy. Players may cancel any account registered to themselves at any time by following the instructions on the Website. SKARA The Blade Remains may stop offering and/or supporting any service at any time.

13.5.05. Players who decide to be involved with the game acknowledge and agree to these and all other relevant rules and will abide by them regardless of the circumstances. In addition, players also agree that these Rules will apply to anyone that is allowed to use their SKARA The Blade Remains account or user ID. By allowing another user to use the account, the account owner is personally responsible for all the consequences (including termination of said account) which may result, if the above discussed person violates any of the listed rules at any time. The account owner will not be entitled to a refund of any currency or any form of credit.

13.6 Prohibitions, restrictions and conditions of use, for all game chats and channels.

You agree not to do any of the following while using the Game or any SKARA The Blade Remains game chat or channels.

13.6.01 Excessive Profanity and Inappropriate language is not welcome. It is suggested to ensure that the censor filter is switched on. The censor filter is not an excuse to break the existing game and chat rules, and excessive profanity will still be moderated.

13.6.02 Typing in such a way to bypass the censor filter is prohibited.

13.6.03. Insults, personal attacks, abuse or harassment are not tolerated on any level.

13.6.04 Racist or nationalistic implications which may create offense to a certain nation, ethnic, religious or racial group are prohibited.

13.6.05 Allusion of racial or national supremacy, as well as discriminative propaganda on any level is prohibited.

13.6.06 Spamming or posting nonsensical messages is prohibited in the game and combat chats. This also includes excessive use of caps, as well as excessive posting of combat results. Spam is seen as a repetitive abusive/malicious activity in any shape or form (not just text) which has a negative effect on another player’s gaming experience.

13.6.07 Begging/Soliciting in any form is prohibited in all game chats and channels. Begging/Soliciting includes but is not limited to: requesting users to transfer real money to the virtual wallet, asking for additional credits, and requests to transfer game currency.

13.6.08 All types of ads for sale, exchange, or other options for the transfer of accounts from one user to another violate EULA and are prohibited in all game chats and channels.

13.6.09 Distribution of user’s personal information without their consent is prohibited.

13.6.10 Slandering users or posting false information about users in all game chats and channels is prohibited.

13.6.11 Attempting to extort information from users, including information necessary for the use of their account are prohibited.

13.6.12 Discussion on, or linking to illegal activities, such as illicit drugs, is prohibited. This includes but is not limited to the linking of, or discussion on, websites dedicated to vulgar, racist, abusive, illegal, or any other content prohibited by the EULA, or linking to the resources that contain such advertisement or content.

13.6.13 Discussion on, or linking to unreleased content, cheats, hacks, Trojan horses, or malicious programs is prohibited. If you suspect that a cheat or hack exists or have any other problems or concerns on these topics, provide the necessary information to technical support.

13.6.14 Discussion on, advertising of, or linking to websites, for the purpose of selling currency, credits, promotional codes, leveling services, or game accounts is prohibited.

13.6.15 Threats of destroying allied player characters as well as the threats of disclosure of ally positions to enemies, regardless of whether the threat was carried out, or not, are prohibited.

13.6.16 Any attempts to cheat or deliberately hinder the in-game event in any way.

13.6.17 Death threats and other threats of violence in real life, directed either against individual users, moderators or administration of the project, are prohibited.

13.6.18 All types of advertising messages are prohibited in general and combat chats.

13.6.19 Mentioning and discussing of other games is prohibited.

13.6.20 Discussion of social, religious, political, illegal or other controversial topics that may create offense is prohibited. This includes but is not limited to negative portrayal of religious and political figures.

13.6.21 Explicit or implicit discussion of the administration and moderators in all game chats and channels is prohibited.

13.6.22 Any kind of provocations for other players to violate the EULA as well as additions to it is strictly prohibited.

13.6.23 Any statements and other actions that violate any applicable laws or regulations are strictly prohibited and will be strongly suppressed.

13.6.24 Any attempt to create nicknames, groups, or organized communities of players associated in any fashion with organizations which violate any applicable laws or regulations is prohibited. This includes but not limited to, direct or indirect references to Nazi symbols, abbreviations and well known leaders.

13.6.25 The use of copyrighted, trademarked, patented, classified, or restricted material or information and the violation of any rights of any party, including rights of privacy or publicity is prohibited.

13.7 Names (Players and Clans), Avatars, Images/Video, Signatures & Clan logos.

Certain content for names, avatars, images/video, signatures & clan logos, have no place on the SKARA forums or within the SKARA game, due to their extremely offensive, annoying or inappropriate nature. The following list is only a summary, but it gives some idea of names, images, signatures, avatars and clan logos which are not accepted with the SKARA environment:

13.7.01 that contains insults, personal attacks, abuse or harassment.

13.7.02 that contains unprintable words or abbreviations, or which are unattractive and/or unreadable.

13.7.03 which have (in any way) racist or nationalistic implications which may create offense to a certain nation, ethnic, religious or racial group.

13.8.04 that contain an allusion of racial or national supremacy, as well as discriminative propaganda on any level.

13.7.05 which are derogatory discriminative or offensive to people with a disability or illness.

13.7.06 which have an association with sexuality, pedophilia, sexual abuse; or have an offensive connection to the human body or bodily functions.

13.7.07 which contain excessive gore or violence, or are obscene/vulgar.

13.7.08 which make reference to addictive or illegal substances or their use, or any other illegal activities.

13.7.09 which either in whole or partly contain copyrighted or registered trade mark elements.

13.7.10 that contain reference to current mainstream religions that may create offense, i.e. names such as God, Jesus, Allah, etc.

13.7.11 that contain logotypes, symbols, emblems or figures connected in one way or another with organizations, that violate or were violating existing laws and rules (for example, using different variations of Nazi symbolic, abridgements and signs (88, 14, 420, SS), or similar stylization (such as, 55) as well as credentials, names and surnames of Nazi leaders) which may provoke strong negative reaction/association or promote national/ethnic/religious hatred.

13.7.12 that are connected with negative historical or political personalities, first of all those who are judged by international courts for crimes against humanity, those that generally arouse feelings of suffering or disgust in the majority of people, as well as members of currently existing terrorist organizations;

13.7.13 that negatively portraits the projects moderators, staff or administration;

13.7.14 which in any other manner violates the End User License Agreement or local laws;

……. either implicitly or explicitly are prohibited (this also contains links to websites containing the above). If names (player or clan), avatars, signatures, images/video, clan logos within the forums or within the game violate these rules the offending account may be changed and/or the accounts may be sanctioned or suspended. Moreover, the administration reserves the right to delete, update or modify any names (player or clans) and avatars, images or clan images which are considered inappropriate on the forums or within the game environment.

Additionally, excessively long forum signatures are not permitted. Signatures may not exceed two lines. If these limitations are exceeded, then the disruptive elements will be removed without explanation and the offending account may receive sanctions. Users are allowed to use images in your signatures, but their size must not exceed 468px×100px (length x width). The signatures can contain animation, but it should not be annoying.

13.8. Inappropriate conduct in game

The following actions are prohibited in game:

13.8.01 Intentionally damaging characters belonging to a player on the same team (team damage).

13.8.02 Intentionally destroying characters belonging to a player on the same team (team kill).

13.8.03 Intentionally blocking characters belonging to a player on the same team.

13.8.04 Intentionally informing participants of the opposing team through combat, or voice chat, the location of characters belonging to players of the same team.

13.8.05 Using bots, clickers, macros, keyboard and mouse recorders, or any other similar methods to accumulate credits and experience without the participation or with passive participation of the player within the battle.

13.8.06 Intentionally exploiting the physics system. This includes, but is not limited to, pushing an allied character into line of fire, pushing allied characters off of cliffs, bridges, into water, damaging yourself against an allied character etc…

13.8.07 Any conduct that is considered by SKARA staff as disruptive to the gaming experience of others can be sanctioned in accordance to rule 1.04. This conduct includes and is not limited to: malicious and/or intentional in-game harassment, intentional exploitation of in-game mechanics or any action that intentionally goes against or abuses the game design. The application of game restrictions will always be done to protect a positive and fun gaming environment and will be applied after careful investigation and internal deliberation.

13.9 Rules Enforcement

The “Automated Anti-Bot Reporting System” is the system that actively scans the game logs searching for players who use automated bots, clickers, macros, keyboard and mouse recorders, or any other similar methods to accumulate credits and experience without the participation or with passive participation of the player.

13.9.01 In the case of detection of single or short-term signs of use of automated scripts (bot software) in user’s logs, user’s account is taken under thorough control by the administration. The owner of the account can be informed by special notifications sent to the registered e-mail.

13.9.02 In case of detection of signs of massive or overt use of automated scripts or botting software in user’s logs, the user’s account is suspended permanently, with a possibility of suspension being lifted in the future, after the administration conducts a complete rollback of characters, achievements, funds (credits), premium consumables and gold.

13.9.03 Automated Anti-Bot Reporting System is not meant to substitute the Technical Support service, the system aims at making their work easier. The most difficult cases thereby will be solved individually via Technical Support service.

13.9.04 Administration does not bear responsibility for any inter-clan relationship. It is at sole discretion of clan leaders, their deputies, and officers to carefully choose clan members (especially whilst assigning clan members to important offices such as the clan treasury). By assigning a clan member to a respective office, the clan leader confirms his confidence in the member. Privates, from their side, confirm that they accept clan rules and regulations by entering the respective clan. Note, that in the event of a conflict within a clan, information, such as treasury logs (and similar) will not be provided on request.

13.10 Reporting in-game violations

Due to the introduction of an automated system of violations tracking (team-damage, team-kill), the administration draws your attention to the following information – with the introduction of this system, users’ complaints about the above mentioned violations will not be considered.

From now on all punishments for team-damage and team-kill will be executed automatically without support service workers’ interference. The system has been customized, tested multiple times and currently works stably. We also draw your attention to the fact that a multitude of all possible circumstances accompanying different violations (including extenuating and aggravating ones) has been taken into consideration.

All requests relating to ban cancellation or minimizing the punishment period, laid by the system, will be ignored.

13.11 Official Language

13.11.01 In-Game General and Company lobby chats: The official language of the In-Game General and Company lobby chats is English. Players who wish to communicate in their native language may do so in channels made specifically for their language.

13.11.02 In Game Combats: The preferred language is English, Non-English is tolerated. Please be tolerant of those that have difficulty speaking English.

13.12 Important/Miscellaneous

13.12.01 Repeated violations of any area of these Rules or the EULA, including the areas detailed above, will often result in permanent suspension from the game and/or forums.

13.12.02 This policy is not language-restrictive. Language that falls under this policy will always be subject to the repercussions listed, whether it is inappropriate in English or any other language.

13.12.03 Players may provide feedback or address any concerns to the Technical Support service at contact@skarathebladeremains.com

14 SKARA’s FORUM RULES

The SKARA forum exists to provide you with a friendly atmosphere where you can discuss ideas, participate in events, share and receive game play advice, and discuss any other aspects of SKARA with other players. Community forums are at their best when participants treat their fellow posters with respect and courtesy. Therefore, we ask that you conduct yourself in a civilised manner when participating on this forum and respect the rules.

However your access to the forum is a “privilege”, and not a “right.” SKARA reserves the right to suspend your access to the forum at any time for reasons that include, but are not necessarily limited to, your failure to abide by these rules. If a member is found to violate any of the forum rules listed below, he/she will be given a temporary ban from the SKARA forums. Depending upon severity of the violation of the rules could be given a permanent suspension.

Before posting any kind of information on this forum, all users are obliged to read and follow the rules posted below.

14.1 GENERAL PROVISIONS

14.1.1 Registration Requirements

There is no requirement for a user to use his or her real name or to use any other form of identification that can be used to easily trace identities, and all e-mail addresses that are provided will be kept private. In order to register on SKARA forum, registrants must be thirteen (13) years of age or older.

Users are solely responsible for protecting their accounts from access by others. Users are strongly encouraged to select a hard-to-guess password and not re-use that password on any other sites where it may be read by the owners or administrators of that site. It is highly recommended that board users do not share their accounts with others, or share their computers used to access the site with others. In case of the lost or hacked around, users are to inform support immediately.

14.1.2 Forum purpose

The purpose of this forum is to discuss SKARA and combat related topics, get to know fellow players, and to give feedback to the SKARA developers.

14.1.3 Responsibility

SKARA is not responsible for any user messages posted. SKARA does not vouch for or warrant the accuracy, completeness or usefulness of any message, and is not responsible for the contents of any message. The messages express the views of the author of the message, not necessarily the views of this board. Any user who feels that a posted message is objectionable is encouraged to contact the support staff or moderators immediately. SKARA employees and community moderators have the ability to remove objectionable messages and will make every effort to do so, within a reasonable time limit, if it is found that removal is necessary. Users agree, through the use of this service, that they will not use this forum to post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person’s privacy, or otherwise in violation of any law. 14.1.4 Ban Policy

Violations of these guidelines may lead to users being banned from this forum as a temporary or even a permanent suspension of their account.

14.2 PROHIBITIONS and RESTRICTIONS

14.2.1 Forum etiquette

Users are not allowed to abuse others, make personal attacks or behave disrespectfully. This prohibition applies to both public threads and private messages (PMs). Disrespect can include:

  1. Flaming
  2. Making non-constructive posts, or creating threads on non-constructive topics
  3. Harassment or Defamatory remarks
  4. Cursing and profanities, Inappropriate language
  5. Personal abuse or attacks
  6. Insults or derogatory comments based on race, nationality, religion, culture, sex, or sexual preference. This includes “jokes” in bad taste.
  7. Excessive Capitalization
  8. Naming and Shaming. Distribution of other forum users’ personal information without their prior consent
  9. Discussion on social, religious, political topics that create controversy as well as negatively portray religious and political figures
  10. Insults towards SKARA Staff (including moderators)
  11. Insults or provocation via PM after being set to RO status or warned for a violation
  12. Death threats and other threats of violence in real life, directed towards either other forum users or members of SKARA staff
  13. Impersonation of the Administration or Moderation team

If a member is found to have participated in such actions, he/she will:

  • Be temporarily banned from the SKARA forums
  • Be given a final warning, with any further violations possibly resulting in permanent ban from the forums

This behavior has no place on the SKARA forums due to its extremely offensive and inappropriate nature.

14.2.2 Distribution of real life information and real-life threats

Postings and discussions which have users’ personal data (such as addresses, telephone numbers, emails, other contact information) – regardless of whether this is their own or that of other users – will be removed. Users who publish this type of content on the forum will be warned or suspended by an administrator or a moderator.

If a thread or post is in violation of the forum rules, users are encouraged to use the report button on the post and provide information as to why the thread or post is in violation.
No rude or disrespectful posts to or about any forum moderators or SKARA employees, as well as no release of real-life information about moderators or SKARA employees are allowed on this forum.

Real-life threats include both clear and masked language and/or links to websites containing such language or images which refers to violence in any capacity that is not directly related to the game world

If a member is found to have participated in such actions, he/she will:

  • Be temporarily banned from the SKARA forums
  • Be given a final warning, any further violations may result in permanent ban from the forums

14.2.3 Advertising

Users are not allowed to post threads or comments here that advertise or solicit any non-beneficial, non-SKARA related businesses, organizations, or websites. Explicit advertising and solicitation in signatures are also prohibited.

If a member is found to have been advertising, he/she will:

  • Be given a temporary ban from the SKARA forums, depending upon severity

Forum rules allow discussing other war games; however any kind of solicitation of or linking to other games is not permitted. Also please do not use images related to games other than SKARA in your signature, avatar or name. You are more than welcome to discuss other war games in our Off Topic section but please do not add them in your signature, avatar or name.

14.2.4 Accounts, Gold/Credits, Pre-order & Promotional codes, Leveling services, Begging.

This category includes:

  • Creating alternative accounts with malicious intentions.
  • Advertising of, or selling of game accounts.
  • Advertising of, or selling of in game currency such as gold/credits.
  • Advertising of, or selling of leveling services.
  • Advertising of, or selling of promotional codes or pre-order codes.
  • Begging in any form. Begging includes but is not limited to: requesting users to transfer real money to the virtual wallet, asking for additional gold/credits, and requests to transfer game gold/credits, promotional codes, pre-order codes, or anything similar.
  • Linking to or promoting websites that contain the above prohibited services.

All types of posts for the sale or promotion of the exchange or transfer of accounts, currency, codes, and other services from one user to another violate the EULA and are prohibited within the forums and game channels.

If a member is found to have participated in such actions, he/she may:

  • Be given a permanent account suspension for both game and forums for SKARA, depending upon severity

14.2.5 Off Topic, spamming and trolling

This category includes:

  • Excessively communicating the same phrase, similar phrases, or pure gibberish
  • Creation of topics that already exist on the forum (Please use search and add to existing topics were possible)
  • Off-topic posting, such as attempting to derail serious threads or creating topics in the wrong forum section
  • Creating threads for the sole purpose of causing unrest on the forums
  • Creating threads for purpose of reporting or discussing in game violations. Such incidences are to be directed to support
  • Causing disturbances in forum threads, such as picking fights, making off topic posts that ruin the thread, insulting other posters
  • Making non-constructive posts, or creating threads on non-constructive topics
  • Abusing the “Reported Post” feature by sending false alarms or nonsensical messages
  • Numbering a thread, posting “First!”, “IBTL” (“in before thread lock”) or any other fad statements
  • “Bumping” posts. Some sections may allow “bumping” in moderation, but users are to check the subsection of the forum to make sure that it is allowed in that section
  • Creation of petition threads or polls that are not aimed at conducting a discussion.

Users should make sure that they post your new threads and postings in the appropriate forum, and users are asked familiarize themselves with the forums. This helps other users and moderators maintain an overview and so be able to respond faster with an appropriate answer to questions. Before beginning a new thread, look to see if an active thread on that topic has already been established using the Search feature. If so, place your comments there instead. Keep discussions about one topic to one thread only.
Posts which drift off topic, or content-free posts will be edited or removed. Posting multiple messages with the same content across several forums is unwelcome and inappropriate, since such activities divide the targeted discussions and makes gathering feedback considerably more difficult. Such ‘cross posts’ will be merged, closed and redirected or removed. If so, place your comments there instead.

14.2.7 Law Violations

This category includes:

  1. Posting discussion threads on, or linking to, cheats, hacks, trojan horses, or malicious programs. If you suspect that a cheat or hack exists, provide the necessary information to support, it is not to be discussed within the forums.
  2. Posting unreleased content / hacking data files: showing unreleased in-game items, equipment, or areas that have been unlocked by hacking into client data files; discussing or displaying any data not available through normal game play;
  3. Illegal drugs or activities. Both clear and masked language and/or links to websites containing such language or images which reference to abusing illegal drugs or to performing illegal activities are prohibited.

If a member is found to have participated in such actions, he/she will:

  • Be temporarily banned from the SKARA forums
  • Be given a final warning, any further violations may result in permanent ban from the forums

Users are expected to act lawfully when participating on the forums. Posting about or discussing issues that violate local or international laws is not allowed under any circumstance.
The administration reserves the right to delete, update or modify any information which is considered inappropriate on these forums.

14.2.8 Discussing disciplinary actions

This category includes:

  1. Creating posts or threads to discuss disciplinary actions taken against a player in game or on the forums
  2. Creating posts or threads to discuss moderators or moderator decisions and actions

14.3 MISCELLANEOUS

14.3.1 Language

The official language of this forum is English. Using other languages is allowed in special forum sections only. Transliteration and intentionally distorted or illiterate language is unwelcome.

Users are to be considerate to those who obviously have difficulties with English, and similarly be considerate to English moderators who sometimes have to moderate in languages other than their own.

14.3.2 Hard-to-Read Posts

Posts that disrupt the message boards for other users, intentional or not, are prohibited. This category includes, but is not limited, to:

  • Conducting conversations in foreign languages, outside the designated International forums
  • Posting solely or predominantly in capital letters; excessive text spacing or line breaks; use of “1337 5p34k” or other hard-to-read writing styles
  • Using misleading topic titles, excessive punctuation, and/or non-standard symbols.
    While posting on these forums users are to be reasonable with font size and color. Stick to default font size and try to avoid use of text colors different from black. The administration reserves the right to modify inappropriate posts and give warnings to their authors.

14.3.3 Links and Images

Whenever linking to a website or image or posting a image, be sure to check that they don’t violate any of the rules above. Sites or images that display illegal content, pornography, nudity, gratuitous violence, Nazi symbols such as swastikas, obscenities and any other content that goes against the standards of this community will be moderated. In addition to the above we also request you not post ASCII art (pictures created by using letters and symbols on a keyboard) they are usually quite large and can be misinterpreted based on display issues.
The size of files and images referred may not exceed 100 kilobytes (kb).

14.3.4 Names (Players and Clans), Avatars, Images/Video, Signatures & Clan logos

Certain content for names, avatars, images/video, signatures & clan logos, have no place on the SKARA forums or within the SKARA game, due to their extremely offensive, annoying or inappropriate nature. The following list is only a summary, but it gives some idea of names, images, signatures, avatars and clan logos which are not accepted with the SKARA environment:

  • that contain unprintable words or abbreviations, or which are unattractive and/or unreadable.

  • that contain an allusion of racial or national supremacy, as well as discriminative propaganda on any level.
  • which are derogatory discriminative or offensive to people with a disability or illness.
  • which have an association with sexuality, pedophilia, sexual abuse; or have an offensive connection to the human body or bodily functions.
  • which contain excessive gore or violence, or are obscene/vulgar.
  • which make reference to addictive or illegal substances or their use, or any other illegal activities.
  • which either in whole or partly contain copyrighted or registered trade mark elements.
  • that contain reference to current mainstream religions that may create offense, i.e. names such as God, Jesus, Allah, etc.
  • that contain Logotypes, symbols, emblems or figures connected in one way or another with organizations, that violate or were violating existing laws and rules (For example, using different variations of Nazi symbolic, abridgements and signs (88, 14, 420, SS), or similar stylization (such as, 55) as well as credentials, names and surnames of Nazi leaders) which may provoke strong negative reaction/association or promote national/ethnic/religious hatred.
  • that are connected with negative historical or political personalities, first of all those who are judged by international courts for crimes against humanity, those that generally arouse feelings of suffering or disgust in the majority of people, as well as members of currently existing terrorist organizations;
  • that negatively portraits the projects moderators, staff or administration;
  • which in any other manner violates the End User License Agreement or local laws;

……. either implicitly or explicitly are prohibited (This also contains links to websites containing the above). If names (player or clan), avatars, signatures, images/video, clan logos within the forums or within the game violate these rules the offending account may be changed and/or the accounts may be sanctioned or suspended. Moreover, the administration reserves the right to delete, update or modify any names (player or clans) and avatars, images or clan images which are considered inappropriate on the forums or within the game environment.

Additionally, excessively long forum signatures are not permitted. Signatures may not exceed two lines. If these limitations are exceeded, then the disruptive elements will be removed without explanation and the offending account may receive sanctions. Users are allowed to use images in your signatures, but their size must not exceed 468px×100px (length x width). The signatures can contain animation, but it should not be annoying.
14.4 FORUM ADMINISTRATION and MODERATION

14.4.1 Administrators and Community Team

Administrators are SKARA’s employees.

The administrator status is confirmed by “Group: Administrators” inscription under the user nickname.

Community Team is presented by “Community Managers” and “Community Coordinators”

14.4.2 Moderators

Moderators are volunteers of forum administration. Recruited from forum members, the moderators are responsible for maintenance of forum rules.

The moderator status is confirmed by “Group: Moderator” and Senior Moderator inscription under the user nickname.

14.4.3 Administrators and Moderators’ powers

Administrators and moderators have right to warn and suspend forum members in the case of forum rules violation. Any measures taken by moderators can be appealed to support via e-mail (contact@skarathebladeremains.com) in accordance with the established procedure. Measures taken by administration are not subject to appeal. In some cases, which go beyond the forum rules, administrators can warn or suspend particular forum member, even if their actions formally don’t fall under the current prohibitions and restrictions.

14.4.4 Warnings

The warnings and official notifications are set off in red, this font color is reserved by Moderators and Administrators. Any other moderators and administrators’ message is considered to be an ordinary one and is equal to a message of any forum member. Once one of a posts has been moderated, users are not permitted to edit the moderators notes placed within the post. Similarly, the impersonation of the administration or moderating team in any way, is not permitted.

Depending on the severity of the violated rule, players may be issued with a different amount of warning points:

Educational Warning – 0 warning point

Minor Rule Violation – 1 warning point

Average Rule Violation – 2 warning points

Severe Rule Violation – 3 warning points

The maximum amount of warning points is 10. After reaching this limit, players should expect to receive a full forum suspension.

14.4.5 Restrictions on Administrators and Moderators

Administrators and support staff being official employee’s are representatives of SKARA, are allowed to play but not partake in clans and clan wars.
Moderators however are not official employees of SKARA and recruited from the player base. They have no special abilities in game to give them any advantage, other than the ability to issue chat bans within the game. So there is no need to limit moderators’ participation within clans or clan-wars. If users believe a moderator to be biased in any way or acted inappropriately, they are to send the details to support at contact@skarathebladeremains.com and it shall be looked at and dealt with by administrators if needed.

15 TERMS OF SERVICE

You confirm that as part of the process of creating a SKARA account (an “Account“) you read and agreed with our Terms of Service.

15.1 Introduction

15.1.1 These Terms of Service govern the relationship between you and

SKARA The Blade Remains Limited, Flat 4, 3-5 Bateman st, London W1D 4AG UK (“SKARA”, “we”, “our” and “us”) in relation to:

  • our websites skarathebladeremains.com, www.playskara.com (each a “Site“);
  • any of our online, mobile and console games (each a “Game”); and
  • any of our other products and services (including support services) which may be accessible via a third party platform, web application or social networking service (together the “Ancillary Services”).

15.1.2 These Terms of Service also govern the relationship between you and us regarding your use of any of the forums that we operate for the Games (the “Games Forums”).

15.1.3 In these Terms of Service we refer to the Games, the Games Forums and the Ancillary Services together as the “Services“.

15.2 Users under the Age of 18

15.2.1 If you are under the age of eighteen (18), please ask your parent or guardian to read and accept these Terms of Service on your behalf before you use the Services. If you (or, if applicable, your parent or guardian) do not agree to these Terms of Service, then you may not use or access the Services or any part thereof. By signing up for an Account (see below, section 5 “Your SKARA Account”), you represent and warrant that you are a “natural person” who is over the age of eighteen (18) or whose legal guardian have accepted and agreed to these Terms of Service.

15.2.2 You agree that you will not knowingly allow any individual under the age of eighteen (18) to use or access the Services without a parent or legal guardian supervising him or her.

15.3 Your SKARA Account

Creating an Account

15.3.1 In order to use the Services, you will need to create a SKARA account (an “Account“).

15.3.2 To create an Account, you must have an e-mail address and will be required to provide certain information. The details of the information that you need to provide are set out in our Privacy and Cookie Policy. It is important that you provide this information truthfully and accurately, so that we have correct details about you and your Account.

15.3.3 When creating an Account you will also be required to provide a ‘user name’ to represent you in a Game and on our Sites. User names are tied to your Account (meaning they cannot be transferred to anyone else). You may not use a user name that is used by someone else, is vulgar or offensive, or otherwise breaches these Terms of Service. If you have questions about Account registration, please contact us at contact@skarathebladermains.com.

15.3.4 Specifically, in order to use the Services for Xbox(R) One Games, you will need to visit the site and sign in using your Microsoft Xbox(R) Live ID credentials. The Account will be automatically created using your Microsoft Xbox(R) Live ID credentials (e-mail and nick name (gamertag)).

In cases, including some iOS and Android Games you may also log in through some third party system, if expressly permitted in the Game.

To access the Services for PlayStation(R)4 Games, you need to have a Sony Entertainment Network account.

Account Sharing

15.3.5 You must keep all information relating to your Account confidential. At no time should you disclose your Account ID or password, secret question or answer to anyone. This includes your friends, children, spouses, co-workers, clan members, and/or clan leaders.

15.3.6 You may, under circumstances, be responsible for the conduct and actions using your Account and for all breaches of these Terms of Service committed by using your Account which are due your culpable omissions or conduct as regards your Account information. We shall have no liability to you for any loss or damage arising from any unauthorised use of your Account or any unauthorised access, use, alteration, modification and/or disclosure of your personal information based on your culpable omissions or conduct as regards your Account information.

Security of Your Account

15.3.7 You must ensure that you secure your Account, computer, mobile phone or other device from third party access. Please notify us immediately at contact@skarathebladeremains.com if you become aware of:

  • any unauthorised use of your Account or any other breach of security; or
  • any hacking tools being used or that might be used in relation to the Services.

15.3.8 We have implemented physical, electronic and managerial procedures in order to help safeguard and prevent unauthorised access, use, alteration, modification and/or disclosure of your personal information. Although we use reasonable efforts to safeguard the security of your personal information, transmissions made on or through the Internet and personal information stored on our servers or the servers of third parties that we use are vulnerable to attack and cannot be guaranteed to be secure. In addition, submissions made by e-mail are not protected by encryption and are vulnerable to interception during transmission.

15.4 Charges and Billing

15.4.1 You do not have to pay any registration or subscription fees to create an Account. However, some of the Services may require you to pay a fee. If you decide to subscribe to any such Services, you must ensure that:

  • you are either over the age of eighteen (18) or, if you are under the age of eighteen (18), that your parent or guardian has agreed to and accepted the respective purchase and these Terms of Service on your behalf;
  • you are the authorised Account holder for the Account from which you are subscribing to the Services;
  • you are authorised to use the particular credit card or other accepted method of payment;
  • all information that you submit is true and accurate (this includes, without limitation, your credit card number and expiration date, so it is important to keep these details updated); and
  • you agree to pay all the fees that you incur, unless and until you close your Account and terminate these Terms of Service in accordance with these Terms of Service.

15.4.2 Any applicable fees and other charges on your Account for Services fully provided by us are not refundable, except as set forth in these Terms of Service, or as it is required under the applicable law.

15.4.3 Please remember that your Account is personal to you and cannot be transferred or traded with any other user.

15.4.4 IF YOU ARE PLAYING OUR GAMES ON EXTERNAL PLATFORMS SUCH AS MICROSOFT XBOX(R), SONY PLAYSTATION(R), APPLE IOS OR GOOGLE ANDROIDTM, YOU MUST ALSO COMPLY WITH ALL TERMS AND CONDITIONS SET BY THOSE THIRD PARTY PLATFORMS. THE CHARGING AND BILLING IN SUCH GAMES ARE SUBJECT TO RULES OF THE THOSE PLATFORMS. SKARA DISCLAIMES ANY LIABILITY OF ANY NATURE FOR SUCH PLATFORMS’ ACTIONS.

15.5 Content

15.5.1 The Services contain a lot of content, including, but not limited to software, technology, text, forum posts, chat posts, profiles, widgets, messages, links, e-mails, music, sound, graphics, pictures or video materials, as well as the design and appearance of our Sites and the Games (the “Content“). Some parts of the Content may only be accessible online and/or require using keys or codes, serial codes and/or online authentication of any kind and in-game achievements in order to be unlocked.

15.5.2 The Content and all of the intellectual property rights in the Content are owned by us (or by our affiliates and partners as applicable). However, during the time these Terms of Service are in force between you and us, we grant you a personal right (known as a ‘licence’) to use the Content in connection with your access and use of the Services. This licence is:

  • ‘non-exclusive’ (meaning that we can grant the same and similar licences to other people as well);
  • ‘revocable’ (meaning that we can terminate this licence in certain circumstances, which are explained further below);
  • ‘personal’ (meaning that you may not use the Content for any commercial purpose);
  • ‘non-transferable’ (meaning that the licence is only for your benefit and you may not transfer or sub-licence any of the rights that we grant to you to any other person);

  • make any commercial use (i.e. for profit) of any Content; or
  • remove, obscure, or alter copyright, patent, trademark, or other proprietary rights notices affixed to the Content.

15.5.4 SKARA will do its best to make the Content available to you as a part of your enjoyment of the Services, but this is subject to some rules which we need in order to ensure efficient running of the Services:

  • we can only make the Content available to you if it is legal for you to have access to the Content in your home country;
  • you may only obtain the Content from us (or from any person that we authorise for this purpose) and you must not obtain Content from any other person or attempt to do so;
  • we reserve the right to refuse your request(s) to acquire the Content, and we also reserve the right to limit or block any request to acquire or obtain Content at our reasonable discretion, in particular insofar as there are technical issues and/or legal restrictions e.g. under copyright law, criminal law, youth protection law etc.;
  • we do not guarantee that any of the Content will be available at all times, in all countries and/or all geographic locations, or at any given time or that we will continue to offer any particular Content for any particular period of time (unless we expressly say otherwise as part of the Services);
  • the Content you have access to is not returnable, exchangeable, or refundable for other Content or for cash, or other goods or services, unless otherwise provided in the present Terms of Service or as permitted in the Services; and
  • we may have to change or update the Content from time to time, but we will post details of any changes in the news section of the relevant Site(s).

15.6 Virtual Goods

15.6.1 The Services may permit you to purchase virtual items, virtual currency (so-called “Currency”) or time-limited premium memberships (virtual items, virtual currency and premium memberships together “Virtual Goods“).

15.6.2 The following provisions apply to the purchase of Virtual Goods. To purchase Virtual Goods, you need to have an Account.

  • To conduct a purchase of Virtual Goods at the Site, you have to click on the “Get Currency” button. Once you get to our premium shop you can then choose the Virtual Goods, which you would like to purchase. The respective price in Euro, US-Dollar or the currency applicable to your region, for the Virtual Good you would like to purchase, will be displayed. You then may choose a payment method and enter your respective payment details. The total amount of a purchase may be adjusted by adding a fee, if any, applicable to the payment method you selected and for mandatory tax payments, if any, required by law. If adjusted, the total amount of the purchase will be recalculated automatically and displayed before you confirm the purchase. If your payment is in a currency other than that of the purchase amount shown on the website, the exchange rate applied on the payment date will depend on the selected payment method.

  • By clicking the “Purchase Now” button (or the likewise conspicuously labelled button concluding the purchase process), or by fulfilling another action required (e.g. sending a message, etc.), you are sending an order to us to purchase the confirmed amount of Virtual Goods. If you have provided valid payment details within your Account, we will process your order. 15.6.3 We set out below the rules that apply to Virtual Goods:

  • Virtual Goods may only be redeemed for other Virtual Goods where permitted in the Services;
  • once you have purchased Virtual Goods, those Virtual Goods are non-refundable and non-exchangeable (whether or not you use them), except as set forth in these Terms of Service, or as it is required under the applicable law;
  • Virtual Goods cannot be sold or transferred to anyone, but you may buy Virtual Goods for another user of a Game through the gift shop applicable to that Game;
  • Virtual Goods cannot be exchanged for cash or any goods or services (except other Virtual Goods as permitted in the Services);
  • we do not make any promises about how or when Virtual Goods may be available for purchase and can update or change Virtual Goods available for purchase at any time;
  • you may only acquire Virtual Goods from us (or from any person that we authorise for this purpose) or from another user of the Game as a gift through the gift shop applicable to that Game, and you must not obtain Virtual Goods from any other person or in any other way or attempt to do so; and
  • we may limit or block a request to acquire Virtual Goods for any reason.

15.6.4 Information concerning the exercise of the right of withdrawal

Right of Withdrawal

  • You have the right to withdraw from any Purchase Contract within 14 calendar days without giving any reason. The withdrawal period will expire after 14 calendar days from the day of the conclusion of the Purchase Contract.

Effects of withdrawal

  • If you withdraw from the Purchase Contract, we shall reimburse to you all payments received from you under this Purchase Contract, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 calendar days from the day on which we are informed about your decision to withdraw from this Purchase Contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
  • If you requested to begin the performance of services under a Purchase Contract during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from that Purchase Contract, in comparison with the full coverage of these services under the Purchase Contract.
  • You lose your right of withdrawal, insofar as the Purchase Contract is a service contract, after the service has been fully performed and if the performance has begun with the your prior express consent, and with the acknowledgement that you will lose your right of withdrawal once the service has been fully performed by us.
  • You lose your right of withdrawal insofar as the Purchase Contract comprises the supply of digital content which is not supplied on a tangible medium if the performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.

Based on the aforesaid you understand that by purchasing Virtual Goods, you consent that we make available these Virtual Goods to you directly after we have accepted your order. You will lose your right of withdrawal once the Virtual Goods have been made fully available to you by us. However, your right of withdrawal is not lost if you purchase Virtual Goods that are granted to you for a certain period of time (e.g. time-limited premium memberships).

15.6.5 Please note that due to technical limitations we cannot warrant that payments made by you via a specific payment method will be reimbursed to you via that same payment method:

You agree that reimbursements for such payments can be facilitated by us via another, common means of payment, e.g. via transfer of money to your bank account, in case reimbursements via these payment methods are technically impossible. In any case, you will not incur any fees as a result of such reimbursement.

15.6.6 Applicable consumer protection law, in particular your right of withdrawal under article 4 of section 8 “Virtual Goods and Virtual Currency”, will not in any way be restricted by the present Terms of Service.

15.6.7 The following rules apply in regard to the gifts made through the Premium Shop:

  • As of the latest ToS update, gifts may be available in SKARA. Please check for updates.
  • Please note that gifts can be made within the same game server region only, i.e. gifts from an account on the EU server cannot be made to players on the North America server.
  • Within 24 hours after a gift is sent, the recipient will receive a notification via email. To receive a gift, the recipient must go to the My Gifts page in the Premium Shop and accept the gift.
  • A recipient may accept or decline a gift. A recipient has 30 days to accept a gift. If it is not accepted within this period, the sender will automatically receive compensation to their account as in-game currency equal to the price of the gift as at the time of purchase.
  • Within 24 hours after a recipient accepts or declines a gift, the sender will receive a notification via email.
  • If the sender of a gift cancels the payment or fails to pay after the recipient accepts the gift, both accounts will be blocked until the circumstances are clarified. Please do not accept gifts from unknown senders.

15.7 Fan Websites

15.7.1 This section relates to any fan website that you may create regarding any of our Games (“Fansites” and each a “Fansite“).

15.7.2 At some of our Sites we expressly designate certain Content such as SKARA game-related images, graphics or artwork and trade marks as being “for fansite use“. In these Terms of Service we refer to this specifically designated Content as “Fansite Content“.

15.7.3 We grant you a non-exclusive, revocable, personal, non-transferable and limited licence (as these terms are defined in article 2 of section 7 “Content” above) to reproduce and redistribute Fansite Content on Fansites. This licence is conditional upon you complying with the following provisions:

  • you acknowledge and agree that we retain ownership of the Fansite Content and have the right to amend, delete, add to otherwise modify any of it at any time;
  • you agree to include SKARA’s trade mark, copyright or other proprietary rights notices when displaying Fansite Content if we request you to do so and in the manner that we request you to do so;
  • you agree to comply with any usage guidelines that we may provide to you from time to time;
  • you shall not remove or alter any identifying information or copyright management information conveyed in connection with copies of Fansite Content, including in digital form, nor challenge SKARA’s ownership (or the ownership of any third party) of the Fansite Content;
  • you shall not use or adopt any trademarks that might be confusingly similar to any Fansite Content;
  • the Fansite will not post material that is disparaging, illegal or infringes on the rights of any third party or that damages (or that might damage) the reputation of SKARA or of any of the Games;
  • except as expressly permitted in these Terms of Service, you shall not rent, lease, reproduce, modify, translate the Fansite Content, or make an adaptation of (including without limitation fiction or visual art), or in any way exploit, any of the Content without our express written permission; and
  • you must not make, or seek to make, any commercial use or profit out of the Fansite Content (including for example by selling subscriptions to your Fansite) without our prior written consent.

15.7.4 If you fail to comply with any of the terms set out in this section, we reserve the right to terminate your licence over the Fansite Content and also to close your Account in accordance with section 15.2 “Suspension and Closure of Your Account / Termination of these Terms of Service”.

15.8 User Generated Content

15.8.1 Some Services permit you to create or upload content which you have created (which we refer to in these Terms of Service as “User Generated Content” or “UGC“). UGC includes, for example: Account personas, forum posts, chat posts, voice chat, messenger type features, profile content and any other Content contributed by users to or on Services.

15.8.2 Users of the Services create, download and use User Generated Content at their own risk. If you upload or make available to other users your UGC via our Services, we do not control, monitor, endorse or own your UGC, and you are commissioning us to host and make available such UGC on our Services and grant to us a respective limited, non-exclusive and revocable license.

15.8.3 In relation to any User Generated Content which you create or wish to make available to other users, you agree to and comply with the following terms and conditions:

  • any part of the UGC which comprises or incorporates any of our intellectual property rights remains our property;
  • you must not upload any UGC that belongs to anyone else unless you have the respective right owner’s authorisation to do so;
  • you must not upload any UGC that infringes the intellectual property rights or privacy or any other rights of anyone else or which is illegal or breaches these Terms of Service;
  • you waive and agree not to assert any moral rights or similar rights you may have in UGC against us;
  • you are solely responsible for your UGC; we do not pre-screen all UGC and do not endorse, approve, or pre-screen any UGC that you and other users may contribute to Services;
  • you must not in any way claim or suggest that any UGC is endorsed, supported by, or affiliated with us;
  • the UGC must comply with all relevant legislation and must not contain any material which may be considered offensive, defamatory, illegal or which could cause any reputational loss or embarrassment to us;
  • if you create any UGC, you are responsible and liable for it; we may, under circumstances, not bear any liability or responsibly for UGC, nor do we provide any support for UGC;
  • if we believe that your use or uploading of UGC breaches any of these conditions, then SKARA may remove, block, edit, move or disable such UGC; and
  • if you contravene any of these conditions, we reserve the right to suspend or permanently remove availability of your UGC and to take any other steps which we consider appropriate.

15.9 Feedback and User Submissions

15.9.1 We are pleased to hear from our users and welcome specific comments about our Services. We may consider creative ideas, suggestions or materials (“Submissions“).

15.9.2 Any and all Submissions that you send to us, whether at our specific request or not, shall be deemed, and shall remain, our property from the time of uploading or transmission.

15.10 Suspension and Closure of Your Account / Termination of these Terms of Service

Termination for Cause

15.10.1 Our and your statutory rights to close your Account and terminate these Terms of Service for good cause remain unaffected by these Terms of Service.

15.10.2 If such a termination for cause is prompted by a breach of a contractual obligation under these Terms of Service from our side, you are entitled to (i) a refund for any payments made by you for Currency that at the time of termination has not been used by you in exchange for other Virtual Goods; and (ii) a pro-rata refund of payments for any premium membership active for your Account at the time of termination. Other than that, you will not be entitled to any refunds or compensation.

Suspension or termination by SKARA

15.10.3 If you are in material breach of these Terms of Service or EULA, then we may, at our reasonable discretion depending on the seriousness of the breach, take some or all of the following actions:

  • suspend your Account for a short period of time;
  • suspend your Account for a longer period of time; and
  • close your Account and terminate these Terms of Service.

If the breach of these Terms of Service is your first breach, if it is not flagrant, if it is capable of cure, and if the circumstances allow us to do so, then we shall give you fourteen (14) calendar days prior written notice of the impending Account closure to give you the opportunity to cure the breach during such time period.

If we suspend your Account, then during the period of that suspension you will not be able to access your Account or use any of the Services. If we close your Account and terminate these Terms of Service, then you will never be able to access your Account and we may also prohibit you from accessing or using the Services in future.

15.10.4 We can also suspend your access to the ‘game chat’ functionality in the Game, and if we do that, then during the period of that suspension you will be able to play the Game and read the ‘game chat’ of other players, but will not be able to participate in ‘game chat’.

15.10.5 We will only close your Account and terminate these Terms of Service in very serious circumstances where we consider that a suspension is not sufficient. For example, this might include a very serious contravention of these Terms of Service, the Forum Rules, or the Privacy and Cookie Policy or where you have contravened these Terms of Service, the Forum Rules, the Privacy and Cookie Policy or any of them on numerous occasions. The same may apply for very serious contravention or contraventions on numerous occasions against (i) a EULA, or (ii) specific Game Rules, which you accepted when installing the Game.

15.10.6 If you believe that we have suspended or closed your Account in error, please contact Customer Support at contact@skarathebladeremains.com.

15.11 Your Right to close Your Account and terminate these Terms of Service without cause

15.11.1 You may close your Account and terminate these Terms of Service without cause at any time by contacting Customer Support at contact@skarathebladeremains.com.

15.11.2 Important note: Any Virtual Goods you purchase from us are directly linked to the existence of your Account. If you decide to close your Account and terminate these Terms of Service without cause, you will lose any Virtual Goods accessible from that Account at the time of the termination. You will then only be entitled to a pro-rata refund of payments for any premium membership active for your Account at the time of termination. Other than that, you will not be entitled to any refunds or compensation.

15.11.3 This present section 14 “Your Right to close your Account and terminate these Terms Of Service without Cause” does not limit your statutory rights of withdrawal under article 4 of section 8 “Virtual Goods and Virtual Currency”.

15.12 Nature of Services

You hereby accept, recognize and understand that we constantly work on further development of the Game and Services, we improve, upgrade and update graphics, features, gameplay and any other Content of the Game in order to make the gameplay enjoyable for you.

15.13 Links to Third Party Sites

The Services may include hyperlinks to web sites operated by third parties including advertisers and other content providers. Those sites may collect data or solicit personal information from you. We do not control such web sites, and are not responsible for their content, privacy policies, or for the collection, use or disclosure of any information those sites may collect.

15.14 Beta Tests

15.14.1 We may give you the opportunity to beta test new games and features of the Sites. Your participation as a beta tester is subject to the following terms and conditions.

15.14.2 Closed beta tests are confidential. The beta games, including information about features and functionality to be offered as part of the games, are confidential. If you participate in a closed beta test, you must safeguard and prevent unauthorised access to, copying, disclosure, and unauthorised use of the beta games. You will carry out the testing personally and not provide access to beta games to any other person. Your obligation to keep the beta games confidential will continue until we publicly distribute, or otherwise disclose to the public through no fault of yours, each of the games and the content that you are testing.

15.14.3 As a beta tester, you are invited to play beta games for the sole purpose of evaluating the games and identifying errors. Nothing in these Terms of Service or the Sites shall be construed as granting you any rights or privileges of any kind with respect to the beta games. The beta games are provided for testing on an “as is” basis and we make no warranty to you of any kind, express or implied.

15.14.4 When playing certain beta games, you may accumulate treasure, experience points, equipment, or other value or status indicators. We may reset this data when the relevant game completes this testing phase or at any time during the testing process. In this case, all player history and data will be erased and each player will return to novice status.

15.14.5 By starting a beta game, you agree that:

  • playing the beta game is at your own risk and that you know that the beta game may include known or unknown bugs;
  • any value or status indicators that you achieve through the gameplay may be erased at any time;
  • we have no obligation to make this beta game available for play without charge for any period of time, nor to make them available at all;
  • this beta game may be available only by subscription once the testing process is complete or at any time in the future;
  • these Terms of Service apply to your use of the beta game during the testing phase; and
  • if the beta test is a closed beta test, you will keep all information about the beta game confidential as stated above and not disclose such information to any other person.

15.15 No Restriction of Consumers Rights

The provisions of these Terms of Service do not exclude, limit or otherwise restrict the rights vested with the consumers upon relevant provisions of applicable law nor may be construed by anyone in this way.
